1. New Market is not simply Frederick County zoning

2. Why Ordinance 2026-05 deserves close attention
New Market has not handled the state ADU requirement with a single quick amendment. Its public meeting archive shows a June draft and staff report, a July amendment draft, an August staff report plus updated/adoptable draft, and a September 10 supplemental staff report with another draft.
For homeowners, that means an older copy downloaded in June or July may not represent the Town’s latest position. Always ask Town Hall for the final adopted version before commissioning construction drawings.
3. Use the September 10 material—not an older draft—as your planning baseline

New Market’s Land Development Ordinance regulates front, side and rear yards, building height, lot area and accessory structures. Even if the final ADU ordinance permits a detached unit, those parcel-specific dimensional rules determine what can actually fit.
Bring a survey or accurate site plan to the Town and ask for the applicable setbacks, lot coverage, height, easements and any accessory-structure restrictions before selecting a prefab model.
6. Water and sewer involve both New Market and Frederick County
This is one of the most useful New Market-specific distinctions. The Town states that Frederick County provides water and sewer service under agreements with New Market. Those agreements govern procedures and availability of water and sewer taps.
