Betterton MD ADU Rules 2026: No Final ADU Ordinance Found, Critical Area & Permit Checks

Last researched: September 19, 2026. Betterton has its own zoning authority, a zoning ordinance posted by the Town with an October 6, 2025 document date, and a new 2026 Comprehensive Plan listed in the Town’s document center. What we did not find in the Town’s current ordinance/resolution library was a separately identified final accessory dwelling unit ordinance implementing Maryland HB 1466.

Homeowner takeaway: Do not assume Kent County’s ADU rule automatically applies inside Betterton. Start with the Town of Betterton and ask for the current enacted ADU ordinance or controlling zoning section, adoption date and effective date. Betterton also has Chesapeake Bay Critical Area review, its own building-permit process, and active water-system capacity planning that can matter for an added dwelling.

Betterton has its own zoning jurisdiction

Betterton is an incorporated municipality with its own Planning & Zoning Commission and Board of Appeals. The Town’s current website identifies those bodies and maintains its own zoning ordinance, zoning map, building-permit forms and Critical Area worksheet.

That means a Betterton mailing address should not be analyzed under Kent County zoning until jurisdiction is confirmed. For a parcel outside Town limits, use our Kent County ADU Rules guide. For a parcel inside Betterton, begin with the Town.

Maryland Planning specifically flagged Betterton’s ADU obligation

In its October 3, 2025 review of Betterton’s draft Comprehensive Plan, the Maryland Department of Planning called out HB 1466 directly. The State noted that local governments with planning and zoning authority must adopt a law authorizing accessory dwelling units by October 1, 2026 and recommended that Betterton use ADU best practices consistent with the Town’s goal of remaining flexible as housing needs change.

That is useful because it confirms Betterton is one of the municipalities expected to implement its own local ADU law rather than simply rely on Kent County’s unincorporated-area ordinance.

We did not find a separately posted final Betterton ADU ordinance

During this September 19 research pass, we checked Betterton’s current website, ordinance/resolution document center, forms page and publicly posted Mayor and Council minutes available through March 10, 2026. The Town’s document center lists its 2025 zoning ordinance, zoning map and 2026 Comprehensive Plan, but it does not currently show a separately titled final 2026 ADU ordinance.

That does not prove Betterton has taken no action. The Town may have amended the zoning ordinance without using “ADU” in the document title, adopted a measure not yet posted, or be preparing final action close to the October 1 deadline.

For that reason, this guide does not invent Betterton-specific size, parking, owner-occupancy or setback numbers. Ask Town Hall for the current signed ordinance or codified section before designing to a local standard.

Maryland still gives homeowners several confirmed baseline rules

Even where Betterton’s final local text is not yet easy to identify online, Maryland law establishes boundaries that a covered municipal ADU law must follow.

  • An ADU must be authorized on land with an existing single-family detached dwelling.
  • The state definition allows an ADU up to 75% of the size of the primary single-family detached dwelling.
  • Maryland Planning says a covered jurisdiction may not set a local maximum below that 75% limit.
  • ADUs are excluded from residential-density calculations under the state framework.
  • Local side and rear ADU setbacks may not be more restrictive than the jurisdiction’s existing accessory-structure setbacks.
  • If additional off-street ADU parking is required, the jurisdiction must complete the state-required parking study and provide a waiver process.
  • Building-code, public-health, environmental and adequate-public-facilities requirements can still apply.

Critical Area review is a real Betterton-specific constraint

Betterton sits on the Chesapeake Bay, so a detached ADU or addition can involve environmental review that would not apply in the same way on an inland parcel. The Town’s forms page publishes a Chesapeake Bay Critical Area Worksheet specifically for construction in the Critical Area.

The Town’s building guidance also requires applicants to identify the acreage of the property that lies within the Chesapeake Bay Critical Area and to provide plot plans showing property lines, roads, driveways, existing structures and proposed structures.

Before selecting a detached ADU location, confirm:

  • whether the parcel is in the Critical Area;
  • whether the proposed footprint affects the Critical Area Buffer;
  • lot-coverage limits;
  • tree-removal requirements;
  • stormwater or erosion-control requirements; and
  • whether additional Kent County or state environmental review is triggered.

Betterton’s permit process starts with the Town

Betterton’s current forms page says building-permit applicants should submit three sets of plans and allow approximately 7–10 business days for permit approval. The Town also publishes separate building regulations, permit fees and Critical Area forms.

Older Town permit guidance, still available from Betterton’s public files, explains that new construction and significant alteration of residential or accessory residential structures require a Town building permit and that applicants must provide plot plans and building plans.

For an ADU, ask the Town whether the project requires:

  • zoning approval under the new ADU law;
  • a building permit;
  • an occupancy permit;
  • Planning & Zoning Commission review;
  • Board of Appeals action;
  • Critical Area review; and
  • any Kent County erosion, sediment, electrical, health or other coordinated review.

Water capacity deserves an early check

Betterton operates municipal water and sewer service. In April 2026, the Town issued an RFP for a Potable Water System Adequacy and Future Capacity Study. The Town’s 2009 Comprehensive Plan also discussed sewer-treatment capacity and nutrient-loading limits, while the new 2026 Comprehensive Plan replaces that older planning framework.

The existence of a capacity study does not mean an ADU cannot be served. It means a homeowner should avoid assuming utility capacity is automatic. Ask the Town whether the additional dwelling triggers any connection, meter, capacity, fixture, impact-fee or service-line requirements.

Betterton adopted an updated Comprehensive Plan in 2026

Betterton’s Town document center now lists a 2026 Betterton Comprehensive Plan. Public meeting records also show that the Mayor and Council adopted an updated Comprehensive Plan through Resolution 2026-01 in February 2026.

The Maryland Department of Planning’s review of the draft had recommended that Betterton address HB 1466 and consider ADU best practices as part of its housing strategy. That makes the final local ADU ordinance one of the important implementation items to verify after the Plan update.
